HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.86 OF 2015 ORDER:

This writ petition is filed seeking a writ of Mandamus declaring the inaction of the 2nd respondent in passing appropriate orders either on the main claim application or on the interim application dated 12-12-2014 for release of Heavy duty tractor with blade-5310 of the Johndeer made bearing Registration No.AP 20 TB 5291 of the Model 2011 as illegal and arbitrary.

2. The case of the petitioner is that he is the owner of the above said vehicle and it was seized on 19-11-2014 by respondents 3 to 5. Thereafter, the petitioner made an application on 12-12-2014 seeking release of the vehicle. So far, no orders are passed on the said application. Aggrieved by the same, the present writ petition is filed.

3. Heard learned counsel for the petitioner.

4. Learned counsel for the petitioner submits that if the vehicle is kept idle and exposed to Sun and rain, it will be damaged. He further submits that the petitioner has not committed any offence under the Forest Act, as such his vehicle may be released.

5. Having regard to the submissions made by the learned

counsel for the petitioner and as the application filed by the petitioner is pending since 12-12-2014 before the 3rd respondent, the 3rd respondent shall consider the same and pass appropriate orders, within a period of two weeks from the date of receipt of a copy of this order. 6.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, pending if any, shall stand closed.
