HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.28633 of 2019 ORDER:

This writ petition is filed seeking Mandamus to declare action of respondent No.5 in visiting the petitioner's house bearing No.43-1/A, Hanuman Nagar, Near ATC Ground, Moulali, Hyderabad, and harassing and threatening the petitioner and his family members to surrender before him, as arbitrary, illegal and without any authority of law. Heard Sri B. Siva Prasad, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.

The learned Assistant Government Pleader for Home on written instructions submits that basing on the complaint made by one Mohd. Ismail Khader, a case in Crime No.734 of 2019 of SHO, Malkajgiri Police Station, for the offence punishable under Section 435 of IPC was registered on 21.10.2019, wherein the petitioner is arrayed as Accused No.1. It is further submitted that pursuant to the registration of the said crime, since the police are investigating into the crime, the petitioner has come up with the present writ petition to bring pressure on the police

TVK,J W.P.No.28633 of 2019 officials and to divert them from investigating into the above crime.

Having regard to the said submission made by the learned Assistant Government Pleader for Home appearing for the respondents, since Crime No.734 of 2019 has already been registered against the petitioner and being investigated into by the authorities concerned, the claim of the petitioner that respondent No.5 is visiting his house frequently without there being any case registered against him, on the face of it, appears to be incorrect and no interference is called for by this Court, at this stage, since the case registered against the petitioner is under investigation.

Accordingly, this writ petition is closed. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
