DURGA PRASAD RAO J U D G M E N T : {Per the Hon'ble Sri Justice Suresh Kumar Kait} Aggrieved by the order and decree dated 31/10/2016 passed by the Principal District Judge, Vizianagaram, in I.A.No. 1693 of 2016 in OS.No. 87 of 2016, allowing the petition filed by the petitioners/plaintiffs under Order-38, Rule-5 read with section 151 of CPC attaching Rs.1,25,00,000/- [Rs. One Crore and Twenty Five Lakhs only] and prohibiting the 6th defendant from paying the said amount to the defendants 1 to 5 from out of the compensation payable to the respondents 1 to 5 in lieu of surrendering their lands admeasuring Acs:27-05 cents situated in survey Nos. 79/1, 82/1, 83/1 and 268 for International Airport at Bhogapuram, pending disposal of the
suit., this Civil Miscellaneous Appeal is preferred by the petitioners/plaintiffs.
2. Sri N. Siva Reddy, learned counsel for the appellants filed letter dated 20/3/2017 before the Registry seeking to withdraw the above appeal on the ground that a letter to this effect was addressed to him by the appellants on 18/3/2017.
