THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.30073 of 2015 ORDER :

Heard learned counsel for petitioner and Sri G. Narender Reddy, learned Standing counsel for the 2nd Respondent and with their consent, the writ petition is taken up for disposal at the admission stage.

This writ petition is filed questioning the action of the respondents 2 and 3 in not taking action on the representation of the petitioner dated 31.08.2015 regarding illegal constructions made by the 4th respondent in plot No.3/4, Sy.No.100 of Nizampet Village of Quthbullapur Mandal, Ranga Reddy District, as illegal.

3. The petitioner is the owner and possessor of plot No.3/2, to an extent of 135 Square yards, Sy.No.100 of Nizampet village, Quthbullapur Mandal, Ranga Reddy District. There is a 15' wide road existing towards eastside of the plot of the petitioner and after obtaining building permission the petitioner constructed a residential house. The 4th respondent who is the owner of Plot No.3/4 in Sy.No.100 obtained permission for construction of building by suppressing the fact of existence of 15' road towards west side of his plot and started construction occupying the 15' feet road and without leaving the set backs. As a result of the illegal constructions, the access to the plot of the petitioner and other plot owners is closed. The petitioner has submitted a representation on 31.08.2015 to the respondents 2 and 3 about the illegal constructions made by the 4th respondent. But the authorities have not taken any steps on the representation of the petitioner and on the other hand, the 4th respondent is proceeding with construction activity. Hence, this writ petition.

4. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to the respondents 2 and 3 to expeditiously dispose of the representation dated 31.08.2015 submitted by the petitioner.

5. Having regard to the same, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the respondents 2 and 3 to consider the representation of the petitioner dated 31.08.2015 and pass appropriate orders as warranted under law within a period of six weeks from

the date of receipt of copy of this order and communicate the decision to the petitioner. The respondent authorities are directed to put the 4th respondent on notice, before passing the orders on the representation of the petitioner. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
