THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2290 of 2016 ORDER:
This criminal petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioners-Accused Nos.1 to 6 seeking to quash the proceedings against them in Crime No.161 of 2015 on the file of Mirchowk Police Station, Hyderabad. Heard and perused the material available on record. The offences alleged against the petitioners are punishable under Sections 403, 420, 463, 468, 474, 474, 109 and 120(b) r/w.34 IPC. The case was registered by the police on the reference made under Section 156(3) Cr.P.C., by the Magistrate and the learned Magistrate has not followed the procedure while referring the matter and the entire allegations arising out of civil disputes between the parties. Hence, this Court is of the view that the case can be investigated into, without arresting the petitioners.
Hence, the police concerned are directed to complete the investigation without arresting the petitioners and file final report, if any, in accordance with law. The petitioners are directed to appear before the Investigating Agency as and when their presence is required and cooperate with the Investigating Agency. With the above directions, the criminal petition is disposed of. Miscellaneous petitions pending in this criminal petition, if any, shall stand closed.
