HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 855 OF 2003 ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the petitioner.

In view of the fact that the interim order that was granted on 1001-2003 for a period of three weeks was not extended thereafter and considering that tax was paid by the petitioner under protest, in our opinion, this writ petition has rendered infructuous. Learned counsel for the petitioner, however, submits that the issue whether the petitioner - institution is entitled for exemption has not been decided finally and, therefore, he seeks liberty to the petitioner to seek exemption, if the circumstances so demand. We grant such liberty subject to outcome of C.M.A No. 860 of 2002 filed by the petitioner. With these observations, the writ petition is disposed of. Miscellaneous petitions, if any, also stand disposed of. No order as to costs.
