HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No. 23273 of 2014 O R D E R:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of respondent Nos.3 and 4 in not conducting survey to the land belongs to petitioner admeasuring Ac.1.07 guntas situated in Sy.No.105, Pothugal Village, Shabad Mandal, Rangareddy District, as illegal and arbitrary.

It is stated that the petitioner along with three others purchased the subject land admeasuring Ac.1.07 gts., situated in Sy.No.105, Pothugal Village, Shabad Mandal, Rangareddy District, under a sale deed dated 21.05.2008, bearing document No.2417 of 2008 and pattadar pass book was issued in his favour. Since then, he has been cultivating the said land. While so, petitioner made an application to respondent No.3 to survey the subject land and to demarcate the same. Pursuant to the directions of respondent No.3, respondent No.4 issued a letter dated 28.01.2014 and also issued notices to the adjoining land owners calling upon them to attend the survey scheduled to be held on 04.02.2014 and raise their objections. Respondent authorities have been postponing conducting

survey on one pretext or the other and did not take any steps to reschedule the date of survey. Hence, this writ petition. Heard.

Learned Government Pleader for revenue takes notice on behalf of respondents. No counter is filed so far. Learned counsel for petitioner sought for a direction to respondent authorities to conduct survey of the subject land belongs to petitioner.

In that view of the matter, respondent Nos.3 and 4 are directed to conduct survey as per rules and demarcate the subject land belonging to the petitioner by giving advance notice to all concerned, if the survey is not already done so far. The entire exercise shall be completed expeditiously, but not later than four weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. No costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
