2017-08-081 pages

THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE Dr. JUSTI CE SHAMEEM AKTHER WRI T PETI TI ON No.25980 of 2017 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) The petitioner seeks a writ of habeas corpus to produce his wife, who is alleged to be in the illegal custody of her parents, respondent Nos.4 and 5. A consequential direction is sought to set her free. Today, the learned Assistant Government Pleader representing the learned Advocate General, State of Telangana, informed us that the petitioner's wife was present in person in the Court. Thereupon, we interacted with the petitioner's wife in-camera. She stated that she is 21 years of age and was not being held by her parents against her will. She further stated that she did not want to have anything to do with the petitioner. When specifically asked, she said that what she had stated was out of her own free will and that she was not being coerced into saying anything against her wishes. This being the situation, we are of the opinion that no cause is made out for issuance of a writ of habeas corpus.

The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs. ____________________ SANJAY KUMAR, J ____________________ Dr. SHAMEEM AKTHER, J 8th August, 2017 siva
