THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2402 of 2015 ORDER:
This Criminal Revision Case is filed by the petitionerAccused aggrieved over the order dated 23.3.2015 passed in Crl.M.P.No.3307 of 2015 in C.C.No.323 of 2015 on the file of the IV Additional Junior Civil Judge, Guntur.
2. The petitioner is alleged to have committed the offence punishable under Section 420 IPC.
On 14.01.2015, as the petitioner failed to appear before the trial Court, NBW was issued against him. Hence, the petitioner filed the above Crl.M.P. seeking to recall NBW issued against him. The said application was dismissed. Challenging the same, the petitioner filed this revision.
3. Learned counsel for the petitioner submitted that the petitioner has moved an application before the Supreme Court for transfer of the case from Guntur to the State of Orissa and the same is pending.
4. Considering the facts and circumstances of the case, the petitioner is directed to appear before the learned Junior Civil Judge and move a fresh application to recall NBW pending against him. On such surrender and on such application being filed, the learned Junior Civil Judge is directed to recall NBW issued against the petitioner. The petitioner is further directed to appear before the learned Junior Civil Judge regularly on all hearing dates.
5. Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions pending, if any, shall stand closed.
