THE HON'BLE SRI JUSTICE A.V. SESHA SAI Writ Petition No.17574 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue an order or direction more particularly one in the nature of writ of Mandamus, declaring the action of the respondents 5 to 7 in seizing Autos (Small Motor Vehicle) bearing Nos.(1) AP10 V 8271 seized on dated 26.02.2015, vide vehicles check report Nos.305929 (2) AP09/Y0336 seized on dated 26.03.2015 vide vehicle check report No.030889, and (3) AP12U 7078 seized on dated 16.04.2015 vide vehicle check report No.021262 and kept the three vehicles at Kushaiguda Depot as illegal, arbitrary, improper and unconstitutional and violative of Article 14 & 21 of the Constitution of India and consequently direct the respondents to release the Autos (small Motor Vehicle) bearing Nos. (1) AP10-V-8271, seized on dated 26-02-2015, and kept at Kushaiguda Depot (2) AP09/Y0336 seized on dated 26.03.2015 and kept at Kushaiguda Depot (3) AP12U 7078 seized on dated 16.04.2015 and kept at Kushaiguda depot from the custody of the respondents and pass such other order or orders as may deem fit and proper in the circumstances of the case."

When the matter is taken up for hearing, the only request made by the learned counsel for the petitioners is to direct the fourth respondent herein-The Regional Transport Authority, Tirumalagiri, Secunderabad, to take appropriate action on the representation said to have been made by the petitioners herein on 19.05.2015. In the facts and circumstances of the case, this Court considers the request of the learned counsel for the petitioners as reasonable. Therefore, without going into the merits of the case, the writ petition is disposed of, directing the fourth respondent to take appropriate action on the representation dated 19.05.2015 said to have been submitted by the petitioners herein and shall pass appropriate orders, in

accordance with law, within a period of two weeks, from the date of receipt a copy of this order. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
