HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.7425 of 2017 ORDER:
Petitioner was imposed punishment of compulsory retirement on allegation that he was involved in Crime No.17 of 2014 registered for the offences under Sections 420 and 493 of I.P.C., of S.V.U. Campus Police Station, Tirupati and that he was unauthorizedly absent. The Criminal Case was ended in acquittal. Thereafter the petitioner filed an appeal before the appellate authority and the said appeal was rejected by order, dated 30-09-2015. Aggrieved by the order of rejection in the appeal, the petitioner filed representation, on 28-10-2016, before the Director General of Police, but the same is not disposed of till date.
A perusal of the said petition discloses that it is treated as revision to the order of appellate authority. Since the revision is stated to be pending, this Court is not inclined to entertain the writ petition and keep the same pending. Accordingly, the writ petition is disposed of, directing the Director General (2nd respondent) to consider the representation of the petitioner, dated 28-10-2016 treating it as revision, subject to maintainability of the revision and pass appropriate orders, as expeditiously as possible, preferably,
>>2<< PNR, J W.P.No.7425 of 2017 within a period of eight (8) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
