HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17564 OF 2016 ORDER:

The case of the petitioner is that he was working in Border Security Force vide ID No.93455637, 130 BSF and is a landless poor person and that the Government has taken a policy decision to assign the lands to the ex-servicemen and the military personnel for raising food crops. The petitioner made an application before the respondent authorities for allotment of the land and the Mandal Revenue Officer issued proceedings vide letter Dis.No.298/2003/S, dated 29.03.2003 allotting temporary patta to an extent of Ac.4.90 cents in Survey No.1192, situated at Gnagavaram Village, Gurajala Mandal, Guntur District.

Subsequently, when the petitioner approached the respondents to handover the possession of the land, the petitioner was informed that the patta allotted to the petitioner on temporary basis cannot be assigned and directed the petitioner to choose another land anywhere in Gurajala Mandal. Then the petitioner searched for the land and noticed the land to an extent of Ac.1.85 cents in Survey No.522/3C-2, situated in Pallegunta Village of Gurajala Mandal, Guntur District and made an application before the 3rd respondent with a request to allot the said vacant land instead of the land in survey No.522/3C-2 which was allotted to the petitioner earlier on temporary basis. The 3rd respondent also issued letter in Rc.No.

10.03.2015 directing the 4th respondent to enquire into the matter and submit report. Thereafter the petitioner also approached the 4th respondent for assignment of the aforesaid land. But, the 4th respondent has not taken action on the same. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Since the 3rd respondent already issued proceedings dated 10.03.2015 directing the 4th respondent to enquire into the matter and submit report, the 4th respondent is directed to take action for submitting report and thereafter the 3rd respondent is directed to take further action in the matter in accordance with law within a period of two months from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.
