Crl.Petition No.8426 of 2022 THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 8426 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal procedure, 1973 seeking pre-arrest bail to the petitioner who is arrayed as Accused No.11 in the event of his arrest in Crime No.222 of 2022 on the file of Station House Officer, Karimnagar I Town Police Station, Karimnagar District, registered for the offence punishable under Section 306 of Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. Perused the record. 3.

The facts of the case are that the petitioner is arrayed as Accused No.11 consequent to suicide note found in the pocket of the deceased. The wife of the deceased lodged a complaint stating that she found her husband with foam in his mouth and taken the deceased to the hospital and while undergoing treatment he died in the hospital. 4.

Though a suicide note was found in the pocket of the deceased in which the name of this petitioner/Accused No.11 and 10 others were written, no specific details were given according to the complaint regarding the complicity of this petitioner in abetting suicide. For the said reasons, this petitioner can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.11 shall be enlarged on bail in the event of his arrest subject to the following conditions:

i) The petitioner/Accused No.11 is directed to surrender before the Station House Officer, Karimnagar I Town Police Station, Karimnagar District within ten (10) days from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) On such release, the petitioner/Accused No.11 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks or until filing of charge sheet whichever is earlier.

iii) The petitioner/Accused No.11 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
