O r d e r :

The petitioners, who are lessess of respondent No.2 and running vegetable stalls in shops bearing Nos.E-10, E-2, E-1, D-33, D-31, D-28, C-5, D-32 & Godown and D-50 situated at Vegetable Market, Prakasam Road, Nalgonda District, filed this Writ Petition on an apprehension that respondent No.2 may dispossess them from the said shops.

At the hearing, Mr.N.Praveen Kumar, learned Standing Counsel for respondent No.2- Municipality, submitted that on receipt of information by the officials of respondent No.2 that the petitioners have sublet the shops to third parties without the permission of respondent No.2, verification was made into the truth or otherwise of the said information and that, so far, no action has been initiated for eviction of the petitioners. He has further submitted that if the verification reveals that the petitioners have sublet the shops unauthorisedly to third parties, respondent No.2 will initiate action strictly in accordance with the provisions of the Andhra Pradesh Municipalities Act, 1965.

In the light of the above submission of the learned Standing Counsel, which is placed on record, and as there is no immediate threat of the petitioners' dispossession from the shops in question, no further adjudication of the Writ Petition at this stage is necessary. However, in the event, any order adverse to the interests of the petitioners is passed, they shall be free to avail a fresh remedy.

Subject to the liberty given to the petitioners as above, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.48105 of 2015, filed by the petitioners for interim relief, is disposed of as infructuous.
