THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5593 of 2013 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C seeking to quash the proceedings in D.V.C.No.78 of 2013 on the file of the Court of the XIX Metropolitan Magistrate, Kukatpally, Cyberabad, Ranga Reddy District, for the offences punishable under Sections 9(b) and 37(2)(3) of the Protection of Women from Domestic Violence Act, 2004.

The learned counsel for the Respondent No.2 herein submits that in view of the stay granted by this Court, the trial Court is of the view that stay is extended to the Respondent No.1 in the D.V.C.. This Court heard the arguments and perused the records. The main relief sought by the Respondent No.2 herein before the trial Court is against the husband.

Considering the facts and circumstances of the case, the Criminal Petition is disposed of with the following directions : The presence of petitioners herein is dispensed with before the trial Court and the trial Court is directed to proceed with the trial in the D.V.C. No.78 of 2013 and to dispose of the case as expeditiously as possible.
