THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N. BALAYOGI WRI T PETI TI ON No. 2402 of 2017 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The petitioner is the applicant in O.A.No.2084 of 2015 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. After the abolition of the Tribunal insofar as the State of Telangana is concerned, the said O.A is kept pending. While so, he filed the present writ petition seeking adjudication of the disputes raised by him in the said O.A. The matters which come before this Division Bench arise out of the orders passed by the Administrative Tribunal. However, in the present case, orders are yet to be passed by the Tribunal and in the light of the subsequent development, no order can ever be passed in the said O.A by the Tribunal.
That being so, Sri P. Lakshmana Rao, learned counsel for the petitioner, seeks liberty to withdraw O.A.No.2084 of 2015 filed by his client before the Andhra Pradesh Administrative Tribunal, Hyderabad, reserving liberty to him to seek reddressal of his grievances raised in the said O.A before the appropriate forum in accordance with law. As we are now informed that service disputes relating to employees of the State of Telangana are being brought before this Court by way of writ petitions, which are listed before the concerned learned Single Judges, we are of the opinion that the petitioner can be permitted to seek withdrawal of the pending O.A.
O.A.No.2084 of 2015 is accordingly dismissed as withdrawn and liberty is granted to the petitioner to seek redressal of the grievances
canvassed by him in the said O.A by way of independent proceedings before the appropriate forum in accordance with law. Office is directed to communicate a copy of this order to the Andhra Pradesh Administrative Tribunal, Hyderabad, which is still seized of the records relating to O.A.No.2084 of 2015 for its intimation and record. The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
