THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.R.C. No.1818 of 2015 ORDER :

The petitioner preferred the present Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved by the order dated 22-07-2015 passed in Crl.M.P.No.897 of 2015 in C.C.No.122 of 2014 by the II Special Magistrate, Kukatpally at Miyapur, R.R.District.

2. The petitioner - accused filed Crl.M.P.No.897 of 2015 under Section 45 of Negotiable Instruments Act read with Section 311 Cr.P.C. to send the cover, which is marked as Ex.P9, to expert for comparison of writing on the cover with that of the writing of the petitioner - accused. The Court below dismissed the petition on the ground that when the reply notice itself was denied, it is not relevant to compare the writing on the cover with that of the writing of the petitioner - accused.

3. Having heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and having perused the material available on record, this Court is not inclined to interfere with the impugned order passed by the court below.

4. Accordingly, the Criminal Revision Case is dismissed.

5. Miscellaneous petitions filed in this revision, if any, shall stand closed.
