HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13232 of 2015 ORDER:

This petition is filed by the petitioner - Accused No. 3 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail to him in Crime No.230 of 2015 on the file of Chivvemla Police Station, Nalgonda District, registered for the offences punishable under Sections 363, 302, 201 and 120-B r/w 34 IPC.

Heard and perused the material available on record. It is alleged that as per the directions of the petitioner, A1 took the deceased in a car to Warangal, where A2 joined with A1 and A3, and they brutally murdered the deceased.

Learned Public Prosecutor submitted that the petitioner is an accused in two other crimes and he was enlarged on bail in the said crimes and while enjoying the bail, he committed the present crime. The person, who commits crime while enjoying bail in another crime, should not be granted bail.

Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Petition is dismissed. _______________ RAJA ELANGO, J 18th December 2015 Nn
