HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 6684 of 2005 ORDER:

This writ petition is filed by the petitioners challenging the action of the 1st respondent in not according approval to the proposals sent by the 4th respondent on 05.01.2005 under Section 116(c) of the A. P. Cooperative Societies Act. A consequential direction is also sought to the 4th respondent to pay the arrears of salary and other benefits to the petitioners.

While admitting the writ petition, this Court directed the 4th respondent to pay the salaries subject to 2% of the working capital or 30% of the gross income whichever is less, vide orders dated 29.03.2005 in WPMP No.8901 of 2005.

When the matter is taken up for hearing, learned counsel for the petitioners submits that by virtue of the interim orders, the salary of the petitioners has been paid.

Learned standing counsel for the respondents contends that the petitioners would be entitled for payment of salary subject to Section 116(c) of the A.P. Cooperative Societies Act and appropriate orders may be passed in this writ petition.

Having considered the said submission, this Court is of the considered view that in view of the interim orders passed by this Court, no further orders are necessary in the writ petition.

Accordingly, the writ petition is closed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
