THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No. 9978 OF 2015 O R D E R:

This Writ Petition is filed by a Field Assistant functioning as such under the Mahatma Gandhi National Rural Employment Guarantee Scheme challenging the validity of the proceedings, dated 26.02.2015 passed by the Project Director placing him under suspension pending inquiry into certain allegations. When the matter appeared on 09.04.2015, Sri M.S.R. Chandra Murthy, learned Standing Counsel, who has accepted notice on behalf of Respondents 2, 3 and 4, has sought for time to produce a copy of the final order said to have been passed by the Project Director and accordingly, he did produce a copy of the final order passed by the Project Director on 27.03.2015, terminating the service of the petitioner. It is also asserted by the learned Standing Counsel that the copy of the said proceedings was also served on the petitioner on 04.04.

2015, though this latter statement has been disputed and denied by the learned counsel for the petitioner. In view of the final orders passed by the Project Director on 27.03.2015, the cause in this Writ Petition does not survive for further adjudication as the order of suspension independently cannot be assailed after the final orders of termination of service itself is passed.

Hence, the Writ Petition is dismissed preserving liberty to the petitioner to take appropriate action against the final order. No costs.
