THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.9931 of 2009 ORDER:
Heard learned counsel appearing for all the parties. The issue relates to building permission sanctioned by the 4th respondent in favour of the 6th respondent and modified by the 2nd respondent through the proceedings impugned in the writ petition.
The 2nd respondent, to the extent the material on record permits, has modified the building permission sanctioned in favour of the 6th respondent and further on the other assertions or claims of petitioner, has left open for working out these grievances by filing a separate suit.
Counsel for petitioner, after arguing the matter for sometime and realising the difficulty in persuading this Court under Article 226, seeks liberty to work out all prayers by filing a suit in the competent civil court.
By leaving all issues open in this behalf for consideration by the c ompetent civil court, if a suit is filed, the writ petition is dismissed. No order as to costs.
