Heard learned counsel on either side.

This writ petition is filed seeking to declare the action of the 3rd respondent in removing the petitioner vide proceedings dated 27.06.2014 as arbitrary and illegal.

The petitioner was appointed as Field A s s i s t a n t , Garudapuram Gram Panchayat, Kalyandurgam Mandal, Anantapuram District. While so, alleging certain irregularities, charge sheet was issued to him, for which, he submitted his explanation. Being not satisfied with the same, the 3rd respondent-Project Director held that the charges levelled against the petitioner were proved and thereby, terminated his services vide proceedings dated 27.06.2014.

Learned counsel appearing for the petitioner submits that no enquiry was conducted against the petitioner and the impugned proceedings were issued solely based on the social audit report. Hence, he seeks to set aside the impugned proceedings.

However, the petitioner preferred an appeal

before the 2nd respondent-Commissioner, Panchayat Raj & Rural Development and the same is pending.

Therefore, the Writ Petition is disposed of directing the 2nd respondent to dispose of the appeal within a period of eight weeks from the date of receipt of a copy of this order duly taking into consideration the explanation submitted by the petitioner in response to the charge sheet and pass appropriate orders thereon. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this writ petition stand closed.
