HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1747 OF 2017 ORDER:
The case of the petitioner is that he filed a suit in O.S.No.376/2012 before the VII Additional Senior Civil Judge, Visakhapatnam for specific performance of agreement of sale dated 14.03.2006 and pending the same, the 4th respondent is trying to alienate the subject property. Regarding the same, the petitioner made a representation on 10.01.2017 before the 3rd respondent requesting him not to register the subject property. As no orders are passed, the present writ petition is filed.
Heard the learned counsel for the petitioner. Learned Government Pleader for Revenue submits that unless any injunction is existing in favour of the petitioner, the respondents 2 and 3 cannot stop registration in respect of the subject land. This Court cannot go into the disputed questions of fact, since admittedly, civil suit filed by the petitioner is pending and it is always open for the petitioner to approach the Civil Court and obtain appropriate orders against the 4th respondent. . With the above observation, the writ petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
