THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.34144 of 2015 ORDER:

The grievance of the petitioner was that the mining authorities were not considering and processing its application for grant of a prospecting licence/quarry lease in respect of the mineral, Laterite, over an extent of Ac.108.00 cents in Ulligogula forest enclosure, adjacent to Bapanadhara USHP, East Godavari District. A counter-affidavit was filed along with an enclosure, being the letter dated 26.03.2013 addressed by the Assistant Director of Mines and Geology, Rajahmundry, to the petitioner, informing it that the area in respect of which the application was submitted by the petitioner attracted the provisions of Section 28 of the A.P. Forest Act, 1967. The petitioner was requested thereunder to submit 11 sets of statutory forms so as to process its application.

Smt. N. Shoba, learned counsel for the petitioner, stated that the understanding of the authority as to the nature of the land is incorrect and prayed that liberty may therefore be given to her client to challenge the same.

In that view of the matter, no adjudication is called for in this writ petition and the same is accordingly closed leaving it open to the petitioner to take appropriate measures in accordance with law in the light of the communication dated 26.03.2013 addressed to it by the Assistant Director of Mines and Geology, Rajahmundry. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
