THE HON'BLE SRI JUSTICE P.KESHAVA RAO CRIMINAL REVISION CASE No.748 OF 2012 ORDER:

Heard the learned counsel for the petitioner as well as the respondents 1 to 3.

The present Criminal Revision Case is filed questioning the orders passed in Crl.M.P.No.41 of 2011 in M.C.No.33 of 2003, dated 12.04.2012 on the file of the Family Court-cum-V Additional District Judge, Tirupati, in issuing the attachment warrant to the Garnishee to attach a sum of Rs.6,000/- per month for a period of 12 months till Rs.72,000/- is recovered from the salary of the petitioner herein.

The learned counsel appearing for the petitioner brought to the notice of this Court that the Ministry of Communications & Information Technology, National Informatics Centre, Karnataka State Unit, represented by the Deputy Director (Administration) issued proceedings dated 19.08.2011 to the effect that the salary of the petitioner has been deducted at the rate of Rs.7359/- per month with effect from March, 2010 to August, 2010 and again in the month of January, 2011, a sum of Rs.10,000/- has been deducted. That apart, pursuant to the orders passed by this Court on 16.05.2012, the petitioner has deposited a sum of Rs.27,846/-. In all, the petitioner has paid a sum of Rs.81,000/-. The subject-recovery sought for in the Crl.M.P.No.41 of 2011 is Rs.72,000/-. That being so, no further cause would survive in the Criminal Revision Case. It is also informed by both the counsel that the main M.C. itself has been disposed of on 04.04.2005.

In these circumstances, no further orders are required and the Criminal Revision Case is accordingly closed. It is needless to observe that in the light of the recovery of a sum of Rs.81,000/-, the impugned order in the Criminal Revision Case is no longer in force and the same is accordingly closed.

Pending miscellaneous petitions, if any, shall also stand closed.
