HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.12347 of 2015 O R D E R :

The petitioners, who are accused Nos.2 to 5 in Crime No.70 of 2015 on the file of Charminar Police Station, Hyderabad, registered for the offences punishable under Sections 406, 420, 421, 465, 468, 471 read with Section 34 I.P.C., filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail. Earlier, petitioners herein obtained interim stay of all further proceedings in Crime No.70 of 2015 of Charminar Police Station, Hyderabad until further orders by order dated 02-12-2015 in Crl.M.P.No.12659 of 2015 in Crl.P.No.12686 of 2015 passed by this Court. When there is stay in favour of petitioners that too restraining the Respondent-Police in proceeding with the investigation, the question of arrest of petitioners does not arise. Hence, there is no apprehension of arrest to petitioners in the hands of Respondent-Police. When there is no apprehension of arrest, the question of grant of anticipatory bail does not arise.

Accordingly, the Criminal Petition is dismissed as infructuous. However, petitioners are at liberty to approach this Court, if there is any threat of arrest in the hands of the Respondent-Police. Consequently, Miscellaneous Petitions pending, if any, in this Criminal Petition shall stand closed.
