HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.25325 of 2018 ORDER:
This writ petition is filed aggrieved by the action of the 1st respondent in interfering with the life and liberty of the petitioner without following due process in FIR.No.79 of 2018 of Vemulapalli Police Station, Nalgonda District. Learned Assistant Pleader for Home produced written instructions stating that crime is registered against the petitioner, who being the owner of the crime vehicle which met with accident, in Cr.No.79 of 2018 for the offence punishable under Sections 304-A, 337 IPC on 19-06-2018. It is further stated that the petitioner is arrayed as A-2 and he is absconding and filed Crl.P.No.6999 of 2018 for quashing the criminal proceedings.
It is to be seen that learned counsel for the petitioner submits that the crime vehicle was released in favour of the petitioners and the petitioner was granted station bail. The certificate issued by Station House Officer concerned dated 25-06-2018 goes to show that the crime vehicle was handed over to the owner of the vehicle i.e. the petitioner. It is not known why in the written instructions, it is stated that the petitioner is absconding and assertion of the petitioner is that he was granted station bail.
When crime is registered against the petitioner, this Court cannot scuttle the power of the police to investigate the
offence, but in the name of investigation the petitioner cannot be harassed.
As it is asserted that the 1st respondent-Station House Officer is harassing the petitioner, the writ petition is disposed of directing the respondents not to interfere with the life and liberty of the petitioner except in accordance with law. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 31-07-2018 Note:
