HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.25191 of 2018 ORDER:

This writ petition is filed aggrieved by the action of respondents 2 and 3 in coming to the house of the petitioner and knocking the doors during odd hours seeking whereabouts of husband of the petitioner in the absence of any complaint against him.

Learned Assistant Government Pleader for Home produced written instructions stating that husband of the petitioner involved in four criminal cases and rowdy sheet was opened in the year 2015 and it is renewed up to 31-12-2018. The husband of the petitioner is required in connection with Cr.No.96 of 2018 and after following the due procedure, action will be taken against him. It is stated that the petitioner is not involved in any crime and the respondent-police never summoned her to the police station and they are not interfering with the liberty and life of the petitioner.

Learned counsel for the petitioner submits that all the three crimes registered against the petitioner's husband ended in acquittal except the case in Cr.NO.96 of 2018. The husband of the petitioner also filed writ petition challenging the rowdy sheet, which is pending.

The only grievance of the petitioner is that the respondentpolice are knocking the doors of the petitioner's house and seeking whereabouts of her husband in the absence of any complaint against him, as such, she seeks a direction to the

police not to harass her or her husband by way of knocking the doors of her house during odd hours in the absence of any complaint. But the written instructions goes to show that the crimes are registered against the husband of the petitioner and the petitioner has also not denied about registration of case in Cr.NO.96 of 2018 against her husband. As such, the investigation of the police cannot be interdicted. In view of the same, the writ petition is disposed of directing the respondent-police not to harass the petitioner during odd hours. But however, this order will not preclude the respondent-police from investigating into any offence registered against the petitioner. It goes without saying that the respondent-police shall not interfere with the life and liberty of the petitioner, except in accordance with law. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
