THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10410 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 to 5 seeking bail in the event of their arrest in connection with Crime.No.137 of 2023 on the file of Kondurg Police Station, Ranga Reddy District, registered for the offences under Sections 467, 468, 471, 419 and 420 r/w. 120 b IPC.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The de-facto complainant is the daughter-in-law of A-1. The son of A-1 i.e., husband of the de-facto complainant died intestate leaving agricultural land. It is alleged that A-1 filed an affidavit before the Tahsildar for mutation of the said property. In the said affidavit filed before the Tahsildar, A-1 is alleged to have stated that there are no other legal heirs to the said property. Thereafter, registered sale deed was executed. 4.

Learned Additional Public Prosecutor would submit that the documents are fabricated, for which reason, petitioners are not entitled for the relief of anticipatory bail.

However, keeping in view that the disputes are amongst the family members pertaining to the property of deceased son and all the transactions are borne by record, the relief of anticipatory bail can be considered, subject to following conditions:-

1) The petitioners/Accused Nos.1 to 5 are directed to surrender before the Station House Officer, Kondurg Police Station, Cyberabad, on or before 30.10.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioners/Accused Nos.1 to 5 shall appear before the concerned Station House Officer, for the purpose of investigation, as and when required.

3) The petitioners/Accused Nos.1 to 5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
