THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.15704 OF 2016 ORDER:

This Writ Petition is filed for the following relief: "... to issue an appropriate writ, order, direction more particularly one in the nature of Writ of Mandamus to declare the inaction of the 3rd and 4th respondents in deviating from the regular practice of calling for all registered Unions/Associations before arriving final settlement as illegal, arbitrary, discriminatory and violation of Section 18 (1) of the I.D. Act, 1947 and is also an unfair labour practice under Section 25 (T) of I.D. Act, 1947 and violative of Article 19 of Constitution of India, consequently direct the respondents to call for all the registered Unions/Associations before implementing the final settlement of wage revision or reconduct the negotiations of final settlement of wage revision with all the three registered Unions/Associations as was done in earlier two occasions in accordance with Section 18 (1) of I.D. Act, 1947 and in accordance with the regular practice from time immemorial and to pass such other order or orders appropriate in the case."

Smt. Bobba Vijaya Lakshmi, learned Standing Counsel appearing for respondents 3 and 4, placed on record the Memorandum of Agreement under Section 18 (1) of the Industrial Disputes Act, 1947 arrived at between the Andhra Pradesh Cooperative Banks Association, Hyderabad, on behalf of the Managements of 13 District Cooperative Central Banks in Andhra Pradesh and the Workmen/Officers of the District Cooperative Central Banks Association.

As on date, the prayer in the Writ Petition has become infructuous.

Learned counsel for the petitioners seeks permission of the Court to withdraw the Writ Petition with liberty to the petitioners to take appropriate steps in relation to the Settlement dated 22.04.2016. Permission is accorded.

The Writ Petition is accordingly dismissed as withdrawn with the liberty as sought for by the petitioners. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
