THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN And THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTH WRIT PETITION No.5795 of 2015 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) The relief sought for in this writ petition is to declare the action of the 1st respondent in auctioning the land of an extent of Ac.3.11 cents in Survey No.162/2 and an extent of Ac.1.78 cents in Survey No.162/1 of Natham Revenue Village in Nagari Mandal of Chittoor District through public auction scheduled to be held on 12.03.2015, though the subject matter is pending before this Court in W.A.No.652 of 2014, as arbitrary and illegal.

The Division Bench of this Court, by its order in W.A.M.P.No.1352 of 2014 in W.A.No.652 of 2014 dated 16.04.2014, directed the purchaser of the property to maintain status quo as regards the property in question. Sri P.Sri Harsha Reddy learned counsel appearing on behalf of the 1st respondent, on instructions, would submit that the auction notice was issued excluding the land which has been sold to the petitioner in the auction and which is the subject matter of W.A.No.652 of 2014; and it is only the remaining extent of land in the said survey numbers which is being put to auction.

In view of the submission of Sri P.Sri Harsha Reddy, learned counsel for the 1st respondent, it is evident that the apprehension of the petitioner, that the property sold to him in auction is being put to sale, is misplaced.

The writ petition is, accordingly, closed. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
