THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 18368 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Home.

With the consent of both the parties, the writ petition is disposed of at the admission stage.

Questioning the inaction of the respondents in considering the representation dated 21.05.2016 made by the petitioner to respondent Nos.2 to 5, the present writ petition is filed. Though various grounds are raised, learned counsel for the petitioner submits that the petitioner is being summoned to the police station everyday and made him sit for hours together, inspite of there being an order granting anticipatory bail. A perusal of the material available on record would show that the petitioner, who is shown as an accused in Crime No.104 of 2016 of Malkajgiri Police Station, Cyberabad, was granted anticipatory bail by the Court of XVI Additional District and Sessions - cum - XVI Additional Metropolitan Sessions Judge, Ranga Reddy District at Malkajgiri, on the certain terms and conditions.

One of the conditions imposed in the order was that the petitioner should make himself available as and when required by the investigating agency for the purpose of investigation in the crime. Learned Government Pleader submits that in view of the above circumstances, the petitioner is being asked to come to the police station everyday.

Learned counsel for the petitioner submits that the presence of the petitioner before the police station may not be necessary everyday and that he has been summoned to the police station

without issuing any notice.

It is to be noted that merely because there is a direction by the Court, directing the petitioner to make himself available as and when required by the investigating agency, that by itself would not mean that he can be summoned illegally to the police station everyday and make him sit for a long time.

Having regard to the circumstances stated above, the present writ petition is disposed of directing the police not to summon the petitioner to the police station except following due process of law. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. ______________________ JUSTICE C.PRAVEEN KUMAR 10.06.2016, vhb
