THE HON'BLE MRS JUSTICE ANIS CRIMINAL PETITION No.3004 OF 2015 ORDER:
This Criminal Petition is filed by the petitioner/A-1 under Section 482 Cr.P.C. seeking to quash the proceedings in Crime No.252 of 2015 of Rajendranagar Police Station, Cyberabad Commissionerate, which was registered for the offences punishable under Section 420 and 506 IPC.
2. A perusal of the record would show that on 03.03.2015, the respondent No.2 paid money to the petitioner for providing job in Air India and petitioner did not provide the job.
3. Learned counsel for the petitioner submitted that petitioner is innocent and not committed any offence and prayed the Court that investigation may go on and the Station House Officer, Rajendranagar Police Station may be directed not to arrest the petitioner/A-1 till completion of investigation.
4. Learned Public Prosecutor argued that the investigation in this case is not yet completed. After investigation only, the true facts will come out if any and prayed this Court to dismiss the petition.
5. Admittedly, the complaint given by the petitioner is under process of investigation by the police. Whether the petitioner has committed the offence or not has to be seen only after completion of investigation. The petitioner/ A-1 has not made out the case for quash the proceedings in Crime No.252 of 2015 for the offences under Section 420 and 506 IPC.
6. Having regard to the facts and circumstances of the case and also the principles enunciated by the Hon'ble Supreme Court in R.P. Kapoor v State of Punjab and State of Haryana v. Bhajanlal, I am of the view that it is not a fit case to quash the proceedings at the threshold.
7. In view of the facts and circumstances of the case, the Station House Officer, Rajendranagar Police Station may proceed with the investigation but directed not to arrest the petitioner/A-1 in Crime No.252 of 2015 till completion of investigation or filing of report.
