HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.18374 of 2017 O R D E R :
The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ, order or direction, more particularly one in the nature of writ of Mandamus declaring the action of the 2nd respondent in not taking any action to enforce the Building Permit Order in permit No.G1/60/2016, dated 17.5.2016 in premises bearing No.6-6-56, Ravindra Nagar Colony, Nalgonda Town, Nalgonda District and consequently, stop the illegal construction of the building, belonging to respondent No.3, whose premises bearing H.No.6-6-56, Ravindra Nagar Colony, Nalgonda Town, Nalgonda District, as illegal and arbitrary.

Heard Sri M.Madhava Reddy, learned counsel for the petitioner and the learned Government Pleader for Municipal Administration appearing on behalf of the 1st respondent and Sri N.Praveen Kumar, learned standing counsel for the 2nd respondent and perused the material available on record.

Considering the facts and circumstances of the case, the 2nd respondent is directed to take appropriate action in accordance with law, if it is found that the 3rd respondent - unofficial respondent is proceeding with construction without proper permission or deviating the permission granted.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in the Writ Petition shall stand closed.
