HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.5815 OF 2017 ORDER:

This writ petition is filed declaring the action of the 2nd respondent in issuing notice in Rc.E.10/4770/2015, dated 01.10.2016 and 20.01.2017 and taking on file, the Revision filed by the respondents 6 to 12, as illegal and arbitrary. Learned counsel for the petitioners submit that in earlier round of litigation, the 3rd respondent directed the parties to approach the Civil Court for declaration of right in respect of the subject property. But the unofficial respondents filed Revision under Section 9 of the A.P.Rights in Land and Pattadar Passbooks Act, 1971 (for short 'the Act') with a delay of six (06) years before the 2nd respondent and the same was entertained by the 2nd respondent, which ought not to have entertained, when the remedy of appeal is available.

Heard the learned Assistant Government Pleader for Revenue.

It is to be seen that the impugned notice is only a show cause notice and petitioners can raise all their objections raised herein before the 2nd respondent and the 2nd respondent is obligated to consider the same before passing the final orders. Normally this Court will not interfere at the stage of show cause notice.

With the above observation, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 23.02.2017 dv
