The petitioner claims to be member of Girijan Joint Farming Co-operative Society. It is stated that there are 41 families cultivating the land admeasuring Ac.120.00 belonging to the Government in Survey No.40 of Bethupally Vilage, Sathupally Mandal, Khammam District. The petitioner stated that as all of them are jointly cultivating the land because of joint patta, they are unable to profitably enjoy the land. Hence, they sought splitting of patta in to individual pattas, and for that purpose, they made an application to Chief Commissioner, Land Administration on 16.12.2014. Alleging in action of their representation, the present writ petition is filed.
From the above facts, though the grievance of the petitioner appears to be genuine, he has to approach the competent authority empowered to split up the pattas, but not the Chief Commissioner of Land Administration. Therefore, I deem it appropriate to dispose of the writ petition, giving liberty to the petitioner to approach the 3rd respondent - Tahsildar by making appropriate application. Upon filing such application, the 3rd respondent shall take appropriate decision in accordance with law, after making necessary enquiry.
With the above direction, the writ petition is disposed Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
