THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 2200 of 2015 ORDER: (Per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) After hearing the learned counsel for the parties, we dispose of the writ petition giving liberty to the petitioner to make a comprehensive representation to the 2nd respondent within seven days from the date of receipt of a copy of this order. On receipt of such representation, the 2nd respondent shall consider the same, after giving an opportunity of personal hearing to the petitioner and pass a speaking order. After considering the representation if it is found that there is no justification to collect the amount then the amount, which has already been collected, shall be refunded, and similar action shall not be taken if there is no justification under the law. The entire exercise shall be completed within a period of three weeks from the date of receipt of the representation. If no representation is made within the time aforestated, then the issue would be a closed chapter.

Pending miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
