THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY WRIT PETITION No.44356 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the second respondent in not considering and passing the orders in the revision and stay petition dated 29.10.2016 filed by the petitioner, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies (A.P.). 3.

Learned counsel for both parties submitted that the revision petition filed by the petitioner is pending before the second respondent.

The only relief sought by the learned counsel for the petitioner is to direct the second respondent to dispose of the revision petition filed by the petitioner and to continue him as a fair price shop dealer till disposal of the revision petition. 5.

In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the case.

Having regard to the facts and circumstances of the case, the second respondent is hereby directed to dispose of the revision petition dated 29.10.2016 filed by the petitioner challenging the orders dated 18.10.2016 in Rc.CS2/109/2016 passed by the third respondent. The respondents are hereby directed to continue the

petitioner as fair price shop dealer till disposal of the revision petition only.
