THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11708 OF 2025 ORAL ORDER:

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/A.4 seeking anticipatory bail in connection with FIR No.143 of 2025 of Noothankal Police Station, Suryapet District. The offences alleged against the petitioner are under Sections 118 (1) and 351(2) of Bharatiya Nyaya Sanhita, 2023.

The facts of the case are that the defacto complainant lodged a complaint before police on 09.07.2025 at 21.30 hours stating that on the same day at about 17.00 hours, the complainant and her villagers Uppula Nagalingam sons have met together with regard to a land issue in the presence of village elders, wherein A.1 to A.6 picked up quarrel with the complainant's son, beat him, pushed him on the road and kicked him with legs on his head, due to which, he received injuries and they also threatened him to kill. As such, requested the police to take legal action against the

- 2 - petitioners. Basing on the said complaint, the police registered the case against the accused.

Heard Sri Angothu Nehru, learned counsel for the petitioner and Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that petitioner is innocent of the alleged offences, he is not present at the scene of offence. Even according to the remand report, petitioner has not beaten the injured and there are no other cases pending against the petitioner. As such, requested this Court to grant anticipatory bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the petitioner has also beat the injured and the alleged offences are serious in nature. As such, prayed this Court to dismiss this criminal petition. 6.

Considering the submissions made by both the counsel and as seen from the remand report the petitioner, along with

- 3 - other accused have abused in filthy language from some distance and there are no specific allegations against this petitioner that this petitioner beat the injured. Considering the circumstances, this Court deems it appropriate to grant bail to the petitioner/A.4 subject to the following conditions: i.

The petitioner shall surrender before the Station House Officer, Noothankal Police Station, Suryapet District, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty five thousand only) with two sureties, for the like sum each.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of

- 4 - BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
