THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4008 of 2016 ORDER:
The prayer of the petitioner in this case is as under: "This Hon'ble Court may be pleased to issue a Writ of mandamus or any other appropriate Writ or Writs, Order or Direction, declaring the action of Respondent Nos.1 & 2 in not conducting investigation and not filing charge sheet in Crime No.245 of 2014 on the file of 2nd respondent as illegal, arbitrary and contrary to the provisions of Code of Criminal Procedure and to consequently direct the Respondent No.2 to forthwith conduct enquiry and initiate proceedings for trial of the case by filing Charge Sheet in Cr.No.245 of 2014 on his file; Award costs and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
2. The Sub-Inspector of Police, Kurnool III Town Police Station, Kurnool District, furnished written instructions dated 16.02.2016 to the office of the learned Government Pleader wherein he stated that upon investigation in Crime No.245 of 2014, which was registered under Section 507 IPC upon the complaint made by the petitioner, the police found that a prima facie case was established against the accused and accordingly laid a charge sheet which was taken on file vide C.C.No.738 of 2015 by the learned Judicial Magistrate of First Class, Kurnool. The case was stated to be pending trial.
3. In the light of the afore-stated developments, the grievance of the petitioner stands settled.
The Writ Petition is accordingly closed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
