THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 8461 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in connection with Crime No.133 of 2022 on the file of Narsampet Town Police Station, Warangal District, for the offences punishable under Section 29 of NDPS Act and 8(c) read with 20(b)(ii)(C) of the NDPS Act.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case of the prosecution is that this petitioner/A1 along with Accused No.2 were transporting ganja.

The police Narsampet intercepted these petitioners and found 40 Kgs of ganja in their possession. Even before they could apprehend the person who was along with this petitioner, the said person escaped. 4.

The learned Public Prosecutor submits that the investigation is complete and charge sheet is already filed.

This Court by order dt.12.07.2022, has granted bail to Accused No.2. Further, there are no other similar cases pending against this petitioner.

Keeping in view that the investigation is complete and the petitioner is in jail since 25.04.2022, the petitioner can be granted regular bail subject to the following conditions. i) The petitioner/A1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Narsampet, Warangal District. (ii) The petitioner/A1 shall appear before the concerned Court on every date of hearing without fail.

iii) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed. _________________ K.SURENDER, J Date: 27.09.2022 Note: Issue CC by today.
