THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7604 of 2016 ORDER:

The suspension pending enquiry order dated 24.11.2015 passed by the 4th respondent-Revenue Divisional Officer, Kadiri, is challenged before this Court.

Initially, the suspension pending enquiry was ordered on 26.08.2015. Thereafter, considering the explanation submitted by the petitioner, the proceedings were issued on 24.11.2015 continuing the suspension pending enquiry. The record reveals that objections were filed by the petitioner through her Advocate one Sri P.C. Byrava Prasad, Advocate, Kadiri.

Learned Assistant Government Pleader Sri Delhi Babu placed on record the written instructions dated 09.03.2016 received from the 4th respondent-Revenue Divisional Officer, Kadiri to the effect that the notices were served on the petitioner on 21.01.2016 and thereafter three notices were issued on 27.01.2016; 10.02.2016 and 29.02.2016 to the petitioner to attend the enquiry, which were proposed to conduct on 04.02.2016;

29.02.2016 and 08.03.2016 respectively.

Unfortunately, neither the advocate nor the petitioner chose to appear. Considering the submissions made on both sides, to avoid the controversy and also to avoid the delay, as the suspension was effected in August, 2015, the petitioner shall appear before the 4th respondent-Revenue Divisional Officer, Kadiri at 2.30 p.m., on 16.03.2016 either by herself or through her counsel, and on which date the 4th respondent shall conduct the enquiry and conclude the respondents shall and pass appropriate orders in accordance with law, after giving an opportunity of being heard the petitioner within a period of three weeks.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs. _____________________________ CHALLA KODANDA RAM, J.
