Heard.

The petitioner claims that he is the absolute owner of the land to an extent of Ac.18.10 cents in Survey No.738 of Gudluru Village and Mandal, Prakasham District. He also claims that he has been granted pattadar passbook vide Patta No.1515 on 18.07.2014 and title deeds were also issued. It is stated that while the petitioner is cultivating the land, respondents 2 and 3 obstructed and threatened him to evict from the subject land and that the latest 1B register is claimed to have been prepared by deleting the name of the petitioner. Questioning the same, the present writ petition is filed.

It is, however, evident from the record that the petitioner has directly approached this Court without approaching recording authority under the A.P. Rights in Land and Pattadar Passbooks Act, 1971. The petitioner has also not availed any further remedy available under the Act. Hence, Mandamus of this nature cannot be issued unless there is a demand and refusal.

With a liberty to the petitioner to take appropriate proceedings before the recording authority under the aforesaid Act or such other remedy, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
