Chelkalapalli Sathish v. The State Of Telangana
THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 8450 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in connection with Crime No.74 of 2022 on the file of Kamanpur Police Station, Peddapalli District, for the offences punishable under Section 420, 306 read with 34 of the Indian Penal Code.
2.
Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.
The case against this petitioner is that he had taken an amount of Rs.7 lakhs from the deceased seven months prior to his suicide and since then the deceased was working. However, five months thereafter, he lost his job and requested the petitioner to return the amount that he has earlier given by taking loans from others, for the reason of not returning the money, the deceased committed suicide. 4.
Admittedly, the allegation of taking money was nearly 7 months prior to the incident. Except stating that after losing his job, the petitioner did not return the money to the deceased, which was allegedly given by the deceased at the time of providing job, there are no other allegations.
5.
Since the petitioner is seeking regular bail and eight witnesses were already examined, the relief of regular bail can be granted on the following conditions;
i) The petitioner/A1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of Judicial Magistrate of First Class at Manthani.
(ii) The petitioner/A1 shall appear before the concerned Station House Officer, on every Monday between 10.30 A.M. to 1.00 P.M. for a period of eight weeks or until filing of charge sheet, whichever is earlier, for the purpose of investigation. iii) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
6.
Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed. _________________ K.SURENDER, J Date: 27.09.2022 tk
