THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.17729 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a Writ of Mandamus, or any other appropriate writ, order or direction, declaring the action of the 2nd & 3rd Respondents in not considering the representation of the petitioner dated 17.05.2017 seeking for granting leave for a period of 3 months i.e., 16.05.2017 to on medical grounds for running the Petitioner's Fair Price Shop No.396, Mythri Nagar, L.B.Nagar, R.R.District, as illegal, arbitrary and violation of principles of natural justice."

Heard learned counsel for the petitioner and also the learned Government Pleader representing the respondents from the written instructions, copy submitted, willing to grant one month leave instead of three months sought by the petitioner otherwise to avoid inconvenience to the card holders to make temporary allotment of the license to run the civil supply shop.

Having regard to the above, with a direction to the petitioner to distribute the provisions drawn already for this month and go for availment of one month leave of clear 30 days from the date of availment till date of joining with clear 30 days gap.

With the above direction, this writ petition is disposed of. Needless to say, any further leave, if at all for any short tenure for the so-called daughter's marriage, is left open to the petitioner to make a fresh application in the event of fixation of the daughter's marriage with marriage card to consider.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
