HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION NO.33633 of 2017 ORDER:

The petitioner prays for a declaration against the inaction of respondents 1 to 4 in registering FIR on the complaint dated 12.09.2017 against respondents 5 and 6, as illegal, arbitrary and consequently, direct registration of crime against respondents 5 and 6.

The Assistant Government Pleader (Home) basing on the endorsement of 2nd respondent submits that keeping in view the law laid down by the Hon'ble Supreme Court in LA LITHA KUM A RI Vs. G O VERNM ENT O F U.P. & O THERS1, the reply as is warranted in this behalf would be sent to petitioner within four weeks from today.

The statement is placed on record and accepted. The petitioner on receipt of communication from respondents is given liberty to work out remedies, on such communication, in accordance with law.

With the above observation, the writ petition is dismissed. No order as to costs.
