HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.25276 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: "to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, to declare the action of the respondent Nos. 3 to 5 herein in coming to the residence of the petitioner day-in and day-out and pressurizing his family members to surrender the petitioner to the 3rd respondent without there being any complaint or case registered against him and thereby causing their interference with his personal life and liberty, as being illegal, arbitrary unconstitutional and violative of Article 21 of the Constitution of India and consequently direct the respondent Nos. 3 to 5 not to take any coercive steps without following the procedure contemplated under the Law."

Learned Assistant Government Pleader for Home produced written instructions stating that no crime is registered against the petitioner or his family members on the file of 3rd respondent and that they never pressurized the petitioner or his family members to come to police station. It is further stated that the police are not interfering with the life and liberty of the petitioner.

In view of the same, the Writ Petition is disposed of directing the respondents not to interfere with the life and liberty of the petitioner, except in accordance with law.
