HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.25358 OF 2018 ORDER: (ORAL) (per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner has challenged order dated 28.06.2018 passed in O.A.No.1240 of 2018 by the Andhra Pradesh Administrative Tribunal whereby the application filed by the petitioner under Section 19 of the Administrative Tribunals Act 1985 has been dismissed.

2. The case of the petitioner is that she wants transfer to Primary Health Centre, Yerraguntla of YSR District on the ground that she is suffering from Kidney trouble and that her father is bedridden. Accordingly, she made transfer application on 14.05.2018 in this regard. Thereafter, vide proceedings dated 04.06.2018, the office of the Commissioner of Health & Family Welfare, A.P., has passed order, as under: "A copy of the reference 5th cited is enclosed herewith. The Regional Director of Medical and Health Services, Kadapa is requested to take necessary action on the proposal of Smt S.Lingamma, PHN (NT), CHC Panyam, Kurnool District for her transfer or deputation to PHC Yerraguntla at your level as per ruels as the RDM&HS, Kadapa is the competent authority, since the Govt. has lifted ban on transfers vide G.O.Ms.No.54, Fin (HR-I, Planning & Policy) Dept., dated 02.05.2018."

3. Since the Government has lifted the ban on transfers vide G.O.Ms.No.54, Finance (HR-I, Planning & Policy)

Department, dated 02.05.2018, the respondents are directed to consider the case of the petitioner for transfer on humanitarian ground. If the decision on vacancy position at Primary Health Centre, as is mentioned in proceedings, vide Rc No.SPL/B4/2017, dated 03.11.2017, is not already taken, it shall be taken by the respondents, within ten (10) days, from the date of receipt of a copy of this order.

4. With the above direction, the Writ Petition is disposed of. No order as to costs.

Miscellaneous Petitions, if any pending, shall stand closed.
