THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.17825 of 2015 ORDER :

The petitioner claims to be the Sarpanch of Narsarajupalem Village. The grievance of the petitioner is that though as a Sarpanch and he being a Chairman of Janma Bhoomi Committee of the village without consulting him, list of ineligible persons for grant of pension is prepared. His further contention is that several eligible persons were illegally excluded from granting the pensionary benefit. Ventilating the grievance, the petitioner submitted a representation to the District Collector, Prakasam District, on 22.12.2014 and also submitted a reminder on 22.01.2015. But so far no orders are passed, Hence, this Writ petition.

As seen from the averments in the affidavit filed in support of the writ petition as well as in the representations submitted by the petitioner to the District Collector, there is no mention of names of persons who according to him are eligible to be considered and who according to him are ineligible persons to be not considered but were recommended. In the absence of these details he cannot expect the District Collector to act upon his complaints and pass appropriate orders.

Having regard to the same, learned counsel for the petitioner submits that the petitioner would be advised to submit a detailed representation giving the details of persons who are ineligible but recommended for grant of pension under the scheme and the persons who are excluded from grant of pensionary benefits, though they are entitled otherwise.

Having regard to the above, the writ petition is disposed of directing the petitioner to submit a detailed representation giving the details of persons who are ineligible but recommended for grant of pension under the scheme and the persons who are excluded from grant of pensionary benefits, though they are entitled. As and when such representation is submitted, the same shall be considered by the District Collector, Prakasam, and pass appropriate orders, as warranted by law within a period of four (4) weeks from the date of receipt of such representation.

5. With the above observations, this writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
