THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9533 of 2015 ORDER:
This criminal petition is filed by the petitioner under section 438 of the Code of Criminal Procedure, seeking grant of anticipatory bail in Crime No.39 of 2015 on the file of Obulavaripalli Police Station, Kadapa District, registered for the offences 353 and 379 IPC and 20(1) (a)(ii)(vi) and 29(4)(b) of A.P. Forest Act, Rule 3 of AP Sandal Wood and Red Sanders Wood & Transit Rules and Section 3 of PDPP Act. Heard and perused the material available on record. The allegation against the petitioner is that he involved in illegal cutting and transportation of the red sandalwood logs. Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against him and only due to political rivalry, he was implicated in the present crime. Taking into consideration the seriousness of the allegations, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner may surrender before the Court concerned and file an application for grant of bail.
Hence, the Criminal Petition is dismissed.
